Maiwald Hosts the “FRAND Case Management Guidelines” Event

In cooperation with the WIPO (World Intellectual Property Organization), the IPDR Forum develops the “FRAND Case Management Guidelines” as a pratical aid for parties and arbitrators in the conduct of complex FRAND license arbitration proceedings. Among other things, the question of to what extent a FRAND dispute should and can be heard and, if necessary, decided before an arbitration court and/or in the course of mediation proceedings is dealt with in detail. To this end, the guidelines point out various options under which the parties can choose – if necessary in consultation with the arbitral tribunal or mediator – and thus ensure that the arbitral tribunal and/or mediator has clear competence. In addition, general points on possible submission agreements and procedural orders are addressed.
