At the end of June, the Federal Patent Court declared a Novartis patent (EP 3 143 990 B1) null and void in its entirety for lack of inventive step (file no. : 3 Ni 13/22). Novartis may appeal the decision of the Federal Patent Court to the Federal Supreme Court. The full text version of the JUVE Patent communication can be found here.
In parallel preliminary injunction proceedings before the Munich Higher Regional Court, in reaction to the decision of the Federal Patent Court, Novartis withdrew the application for an injunction against our client.
